terms of service

These terms are a contract between you and Constella App, Inc. ("Constella", "we", "us") governing your use of Brody, the usebrody.com website, and related services (together, the "Service"). By texting Brody, adding it to a chat, or using the site, you agree to these terms. If you do not agree, do not use the Service.

1. What Brody is

Brody is an AI participant you can add to group conversations. It reads the chats it is added to and replies when summoned: settling arguments, summarizing missed messages, remembering decisions, and making jokes. Brody's verdicts and roasts are entertainment, not professional advice. They are generated by an AI and can be wrong, unfair, or out of pocket. Do not rely on Brody for legal, medical, financial, or relationship advice, or for anything with real consequences.

2. Eligibility

You must be at least 13 years old to use the Service, and at least 18 (or the age of majority where you live) to purchase a subscription. By adding Brody to a chat, you confirm you have the right to do so and that participants are permitted to use the Service.

3. Adding Brody to a group

Group chats belong to the people in them. When you add Brody, it announces what it does and how to remove it. Anyone in the chat can remove Brody at any time, not just the person who added it. You are responsible for making sure your group is comfortable having Brody in the chat.

4. Acceptable use

You agree not to use the Service to: harass, threaten, or defame anyone; target people based on protected characteristics; attempt to extract another person's private information; probe, breach, or reverse-engineer the Service; use Brody's output to make consequential decisions about people (employment, credit, housing, and the like); or violate any law. Brody refuses certain requests by design — attempting to circumvent its safety behavior is a violation of these terms. We may suspend or terminate access for violations.

5. Subscriptions and billing

The free plan includes a limited number of summons per week. Brody Pro costs $9.99 per month or $79 per year, paid by the person who subscribes ("the installer"), and renews automatically until cancelled. You can cancel anytime; cancellation takes effect at the end of the current billing period, and reverts the group to the free plan. Prices may change with at least 30 days notice — changes apply from your next renewal, never mid-cycle. Except where required by law, payments are non-refundable.

6. Your content

You own your messages. You grant us a limited license to process message content in chats Brody is in, solely to operate the Service as described in our privacy policy. If you submit a screenshot to the "things brody has said" wall, you grant us a license to display it on the site and in marketing, and you confirm everyone visible in it consented to the submission.

7. Availability

The Service depends on third-party messaging platforms we do not control. We may modify, suspend, or discontinue features at any time. We aim for reliability but the Service is provided without uptime guarantees.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT BRODY'S OUTPUT WILL BE ACCURATE, APPROPRIATE, OR CONFLICT-RESOLVING. A VERDICT HAS A LOSER; THAT IS THE PRODUCT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONSTELLA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR FRIENDSHIPS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

10. Indemnity

You will indemnify and hold Constella harmless from claims arising out of your violation of these terms, your content, or your addition of Brody to a chat without the group's consent.

11. Disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Before filing a claim, contact us at team@constella.app — most disputes can be resolved informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction. Either party may bring qualifying claims in small-claims court instead.

12. Changes to these terms

If we change these terms materially, we will notify you by text or in-chat message at least 14 days before the changes take effect. Continued use after that means you accept the new terms.
